Kommentar: Die Veranstaltung bietet eine Einführung in das wissenschaftliche Arbeiten am Beispiel des verfassungsrechtlichen Konzepts der wehrhaften Demokratie. Dabei soll insbesondere die Ermordung Walter Lübckes und der in dieser Angelegenheit eingesetzte Untersuchungsausschuss im Hessischen Landtag besondere Berücksichtigung finden. Die Veranstaltung findet in Kooperation mit dem Untersuchungsausschuss statt. Als mögliche (aber keineswegs abschließende) Themenfelder kommen in Betracht:
· Entwicklung und Geschichte der wehrhaften Demokratie
· Normative Rückbindung der wehrhaften Demokratie
· Europäische Union als wehrhafte Demokratie?
· Parteiverbote (insb. NPD-Verbotsverfahren)
· Der “Lübcke-Prozess”
· Bedeutung des Untersuchungsausschusses im Parlamentarismus
· Verfahrensrecht des Untersuchungsausschusses
· Kollision parlamentarischer Untersuchungen mit parallelen Gerichtsverfahren
· Rolle der Geheimdienste im demokratischen Verfassungsstaat
· Parlamentarische Kontrolle der Geheimdienste
· Rechte Hasskriminalität und Attacken auf Politiker*innen
Die Teilnehmer*innen erhalten Gelegenheit, eine kurze wissenschaftliche Abhandlung zu verfassen (8-10 Seiten) und diese anschließend in mündlicher Form zu präsentieren (10 Minuten). Nach einer zweistündigen Auftaktveranstaltung am 5. November 2021 haben die Teilnehmer*innen vier Wochen Zeit für die Anfertigung ihrer schriftlichen Ausarbeitungen. Im Dezember 2021 findet eine Blockveranstaltung statt, im Rahmen derer die Ausarbeitungen präsentiert und diskutiert werden. Geplant sind außerdem der gemeinsame Besuch (in Präsenz) einer Beweisaufnahme des Untersuchungsausschusses Walter Lübcke im Hessischen Landtag sowie ein Treffen mit dem Obmann des Untersuchungsausschusses, jeweils im Januar 2022.
Bemerkung: Die Teilnehmer*innenzahl ist beschränkt. Bei einer Überschreitung der maximalen Teilnehmer*innenzahl findet ein Auswahlverfahren statt. 10749 Völkerrechtstheorie

Kommentar: Völkerrechtstheorie spielt eine entscheidende Rolle, wenn es darum geht, die oft allgemeinen und interpretationsoffenen völkerrechtlichen Normen und Prinzipien zu konkretisieren. Zugleich kristallisieren sich in theoretischen Entwürfen normative Vorstellungen darüber, was das Ziel einer internationalen Rechtsordnung ist oder sein sollte. Im Kolloquium wird eine Auswahl bedeutender klassischer und zeitgenössischer völkerrechtstheoretischer Entwürfe behandelt. Dabei kommen sowohl affirmative völkerrechtstheoretische Konzepte als auch kritische Gegenentwürfe zur Sprache. Jede Sitzung lesen und diskutieren wir einen Text, dessen Hauptaussagen idealerweise je von einem Teilnehmer oder einer Teilnehmerin kurz vorgestellt werden. Das Kolloquium ist als Lektürekurs ausgelegt und setzt die Lektüre der zu diskutierenden Texte voraus. Ein genauer Veranstaltungsplan wird zu Beginn des Semesters bekannt gegeben.

Kommentar: Die Veranstaltung richtet sich an Studierende des Schwerpunkbereichs 6 sowie an interessierte andere Studierende, ggf. auch aus der Politikwissenschaft. Jede Doppelstunde besteht aus einem Vortrag eines Praktikers bzw. einer Praktikerin, sowohl aus dem Auswärtigen Amt und anderen Bundesministerien, aber auch aus Nichtregierungsorganisationen. In diesem Vortrag werden aktuelle völkerrechtliche Fragen vorgestellt. Im Anschluss an den Vortrag wird diskutiert und gefragt.
Das Kolloquium dient der Vertiefung einzelner völkerrechtlicher oder völkerrechtlich relevanter Fragenstellungen im Dialog mit Praktiker*innen.

Kommentar: Das Völkerrecht wurde lange Zeit als eine Kooperationsordnung wahrgenommen. Insbesondere in den 1990er Jahren schien es, als könnten internationale Konflikte einvernehmlich, insbesondere durch die Institutionen der Vereinten Nationen geregelt werden. Seit ungefähr zwei Jahrzehnten aber ist eine Repolarisierung der internationalen Beziehungen zu verzeichnen, die auch mit Verschiebungen in den globalen Kräfteverhältnissen einhergeht. Das Seminar gibt Gelegenheit, verschiedene Phänomene dieser Entwicklungen zu analysieren, sowohl gegenwärtige konflikthafte Dynamiken als auch historische Momente, in denen völkerrechtliche Normen oder Grundprinzipien von Staaten oder anderen Akteuren in Frage gestellt worden sind.

Kommentar: Studierende der Humboldt European Law School schreiben verpflichtend eine Examensklausur im Europarecht. Die hierfür relevanten zivilrechtlichen Aspekte des Europarechts werden in der Lehrveranstaltung aufgearbeitet. Die examensrelevanten Fragestellungen des Europarechts werden in der Lehrveranstaltung aufgearbeitet. Schwerpunkt ist dabei die Verfestigung grundlegenden Systemverständnisses, sowie die Wiederholung des unentbehrlichen Rechtssprechungskanons. Neuere Entscheidungen des EuGH finden besondere Berücksichtigung. Die Veranstaltung wird ergänzt um eine Probeklausur, die das gesamte Europarecht abbilden kann.
Diese Veranstaltung ist ausschließlich für Studierende der Humboldt European Law School gedacht.

The lecture "International and European Human Rights Protection" should provide a deeper insight into the material and procedural rights of human rights protection. Current case law will be given special attention.
Content: Part I focuses on the institutional framework of human rights protection within the UN system as well as review and enforcement mechanisms established by international human rights pacts. Part II deals with human rights protection at European level. Special emphasis will be laid on the European Convention on Human Rights and the case law of the European Court of Human Rights. In the course of the discussion, comparisons between the theory, dogma and case law of international human rights protection will be made.

The Proseminar "Current Issues of International Law" allows participants to write an essay paper (20-25 pages) based on current and fundamental issues of international law (examples for the topic: interstate prohibition of violence, international humanitarian law, international human rights law, international economic law, international environmental law, state responsibility) and to hold a short presentation (10-15 min).

This course deals with the basic principles, the subjects and the sources of international law and introduces the structure of the United Nations, the law of human rights and State responsibility as well as principles of humanitarian law. Along with this lecture, the training course “Völkerrecht in Fällen” is held. The lectures 10740 and 10741 are considered together as one single course.

This lecture deals with some more in-depth questions of European economic law based on the knowledge and competencies already obtained in the lecture of European law. The focuses of this course are the fundamental freedoms of the single market, complementary harmonization of legislation as well as the foundations of the competition law (anti-trust law and state aid law).

10522 Introduction to Academic Work – Classic Cases before the International Court of Justice

This seminar (categorized as “Schlüsselqualifikation”) aims to introduce students to academic working methods in preparation for writing a seminar or research paper in the course of the “Schwerpunkt”-studies. Students are expected to give a presentation on 1-2 classic cases before the International Court of Justice and write a short seminar paper of 15 pages. During the seminar, they will also be able to learn about the important decisions of the ICJ and obtain an overview of the development of the case-law.

The course examines the role of international law over time. Can we, under the current changing conditions, still observe an increasing juridification of international relations based on a universal understanding of values, or are we, to the contrary, rather facing a significant crisis of confidence in international law, including an informalization or a reformalization of international law, or even an erosion of international legal norms? Would it be appropriate to revisit classical elements of international law in order to react to structural changes, which may give rise to a more polycentric or non-polar world order? Or are we simply observing a slump in the development towards an international rule of law based on a universal understanding of values? These questions will be discussed from the point of view of different treaty regimes, but also from a more general perspective.

Die Veranstaltung richtet sich an Studierende des Schwerpunkbereichs 6 sowie an interessierte andere Studierende, ggf. auch Politikwissenschaftler. Jede Doppelstunde besteht aus einem Vortrag eines Praktikers bzw. einer Praktikerin, in der Regel aus dem Auswärtigen Amt und anderen Bundesministerien. In diesem Vortrag werden aktuelle völkerrechtliche Fragen vorgestellt. Im Anschluss an den Vortrag wird diskutiert und gefragt.

The course is part of an on-going collaboration between Princeton University and Humboldt University Berlin. It will co-taught by Professors Kim Lane Scheppele (Princeton) and Georg Nolte (Humboldt). The aim is to give students a deeper understanding of basic features of (mainly) US and German constitutional law and its underlying cultures, with a focus on questions which have an extraterritorial and an international law dimension. The course involves discussing, in particular, the role of key concepts, such as “Human Dignity”, and the role of historical experiences, as well as current topics such as “Freedom of speech and Charlie Hebdo”, “The right of privacy in cyberspace”, “The decision to use armed forces abroad” and “The regulation of external security services”.

Security is a core function of every legal order. In international relations, security is particularly difficult to achieve. International law is designed to make a decisive contribution to ensuring security, but it cannot always live up to expectations. During the last decade international law has been confronted with dramatic security challenges, such as ethnic conflicts, terrorism, or the proliferation of weapons of mass destruction. Syria, Iran/Israel, Libya, Kosovo, Guantanamo, Kundus are shorthand designations of larger legal issues, such as the meaning of 'responsibility to protect' and of 'human security', preventive self-defence, unilateral interpretation of Security Council resolutions, secession, the concepts of war or armed conflict, targeted killing and detention. The course should give students a deeper understanding of the content, development and context of the applicable international law.

Security is a core function of every legal order. In international relations, security is particularly difficult to achieve. International law is designed to make a decisive contribution to ensuring security, but it cannot always live up to expectations. During the last decade international law has been confronted with dramatic security challenges, such as ethnic conflicts, terrorism, or the proliferation of weapons of mass destruction. Syria, Iran/Israel, Libya, Kosovo, Guantanamo, Kundus are shorthand designations of larger legal issues, such as the meaning of 'responsibility to protect' and of 'human security', preventive self-defence, unilateral interpretation of Security Council resolutions, secession, the concepts of war or armed conflict, targeted killing and detention. The course should give students a deeper understanding of the content, development and context of the applicable international law.
